General Conditions of Use of Services

Article 1 – Parties and purpose

These Terms and Conditions of Use (hereinafter referred to as "the Terms and Conditions of Use"). « CGU ») are concluded between :

  • BBA – Brasserie des Beaux-Arts, SAS with a capital of 3,000 €,
    registered with the RCS of Bourges under the number 987 814 688,
    head office 1 Place Cujas, 18000 Bourges,
    represented by Laurent Vernin as a leader
    (hereinafter: « Brasserie » or « Editor »),
  • Any natural person using the services offered by the Brasserie,
    in particular via the website and/or partner solutions
    (hereinafter: « User » or « You »).

These Terms and Conditions define the conditions for the use of the Services,
and the rights and obligations of the Parties.

Article 2 – Proposed services

The Brasserie provides its Users with the following services:

  • Online reservation of a table at the restaurant,
  • Click & Collect commands (if available),
  • Consultation of menu and practical information,
  • Online or table payment via secure module,
  • Publication of online reviews after an experience at Brasserie.

These services are provided through the solution Zenhead SAS,
interconnected with Brasserie systems.

Article 3 – Acceptance of EGUs

The use of services involves reading, understanding and
full acceptance of these GUCs.

You declare to be a major or an emancipated minor and have the capacity
legal requirements.

Article 4 – Reservations and orders

Reservations and orders are made via the Zenchef online module,
accessible on the Brasserie site or via partner platforms.

Personal information (name, first name, email, telephone) may be requested
to validate your reservation.

In order to avoid late cancellations or absences, the Brewery may require:

  • a bank footprint (no immediate flow but sampling in case of non-presentation or late cancellation),
  • or prepayment (arrhes paid at time of booking).

The precise terms (amount, deadlines, cancellation conditions) are indicated
at the time of booking on the module.

Article 5 – Menu Consultation and Table Payment

Brasserie can offer online menu consultation via QR code
as well as table payment thanks to a secure module.

You are asked to check the conformity of the addition with your consumptions
before any payment. Note sharing is possible if this feature is enabled.

Methods of payment accepted include:
credit card, Mastercard, Visa, American Express, Google Pay, Apple Pay,
and dematerialized restaurant titles.

Article 6 – Online opinions

After you arrive, you can be invited to leave an online review
via a form or link transmitted by email or SMS.

Opinions must remain respectful and in accordance with the law.
Brasserie reserves the right to moderate or delete any notice
contrary to these Terms of Reference.

Article 7 – Prohibitions

By using the services, you are prohibited from:

  • providing incorrect information,
  • to disseminate defamatory, offensive, obscene, racist or contrary to the law;
  • affecting the safety or proper functioning of the services,
  • usurping intellectual property rights (logos, trademarks, etc.),
  • attempt to bypass or degrade the technical systems in place.

Article 8 – Security

You are responsible for the security of your equipment and data
the use of services.

Brasserie deploys the necessary means to ensure safe access
services and prevent unauthorized access.

Article 9 – Liability

Brasserie is solely responsible for the direct and proven damage suffered
by the User in connection with the use of the services.

It shall not be liable for:

  • force majeure,
  • misuse of services by the User,
  • malfunction of the User's hardware or network.

Article 10 – Insurance

Brasserie attests to having taken out professional liability insurance
covering its activities. The details of the insurer may be communicated
upon written request.

Article 11 – Evidence agreement

Electronic exchanges (emails, notifications, booking or payment logs)
have evidence between the parties.

Article 12 – Miscellaneous

  • Non-renunciation: the failure of one of the Parties to avail itself of a right does not constitute a waiver.
  • Major Force: the bonds are suspended in the event of an unpredictable and irresistible event.
  • Invalidity: if a clause is found to be void, the remaining clauses shall remain applicable.
  • Independence: Parties shall act independently.
  • No right of withdrawal: In accordance with the Consumer Code, the right of withdrawal does not apply to catering services provided on a specified date.

Article 13 – Mediation and litigation

In case of dispute, you can apply for free a consumer mediator,
in accordance with articles L612-1 et seq. of the Consumer Code.

Article 14 – Applicable law and jurisdiction

These GUCs are governed by French law.
Any dispute shall be brought before the competent French courts.
The reference language is French.
